Stephen DeNittis, partner at DeNittis Osefchen Prince, P.C., out of Marlton NJ, Philadelphia and New York and Michael Galpern, Partner at Javerbaum Wurgaft Hicks Kahn Wikstrom and Sinins, P.C in Mount Laurel, announced today the filing of a class action complaint against Health Plus Surgical Center. The class action complaint and jury demand is being filed in New Jersey Superior Court, Essex County on behalf of over 3,700 pateints who were exposed to potentially life-threatening and disabling diseases such as hepatitis B, Hepatits C, and HIV because of poor sterilization practices of medical equipment used during the performance of various surgical procedures of more than 3,700 people between January 1, 2018 and September 7, 2018. The complaint, based, in part, on admissions made by defendant, seeks medical monitoring asd medical testing damages for exposed individuals and other injunctive relief.
Both DeNittis and Galpern have extensive experience in New Jersey class actions and medical injury claims. Both firms issued the following statement about the case: “Today we took the first step towards achieving a remedy for 3700 citizens exposed to potentially deadly diseases through no fault of their own. The ounce of prevention which HealthPlus failed to initiate has now materialized into a potential public health disaster. We are hopeful that HealthPlus will understand the gravity of the situation and work towards meaningful medical monitoring to prevent a catastrophe.”
If you were someone who received a form letter from Health Plus you may be entitled to relief regardless of whether you have contracted a disease. For further information about the suit Mr. DeNittis can be reached at 856-797-9951.
