On June 7, 2013, New Jersey Superior Court Judge the Honorable Robert J. Malestein, J.S.C. granted final approval of a class action settlement entered into in Mitchell v. Title Co. Of Jersey, Docket No. SLM-L-67-12. The settlement entered into provided 16,250 class members in New Jersey who attended a closing with Title Co. of Jersey (“TCJ”) between March 16, 2006 and the June 6, 2013 the opportunity to file a claim and have their closing documents reviewed to determine if they were overcharged by TCJ. Any person overcharge will receive a 100% refund of the overcharge. Refunds range anywhere between $10 to $200. Some persons were not overcharged. Judge Malestein stated on the record that Stephen DeNittis, Esq. of DeNittis Osefchen, P.C. did an excellent job representing the class and that his qualifications show him as being one of, if not the most, experienced class action litigatiors in the State.
