Unwanted Text Messages
In general, the TCPA is violated if:
- You received a text message on your cell phone;
- The text was sent in the last 4 years;
- You did not give consent to the sender of the text to send you these texts; or
- You had given consent at one time but subsequently revoked consent.
Unwanted Robocalls/Automated Calls
If you have received telemarketing calls, prerecorded or autodialed calls to your cell, you may be able to bring a lawsuit against the person or business for a violation of the TCPA.
In general, the TCPA is violated if:
- You received an automated or pre-recorded call on your cell phone;
- The call was made in the last 4 years;
- You did not give express consent to the caller to call you on your cell phone with automated calls; or
- You had given consent at one time but subsequently revoked consent.
Junk Faxes
If you received an unsolicited advertisement sent to your business or personal fax machine or e-fax number without giving your prior express invitation or permission, you may be able to bring a lawsuit against the person or business for a violation of the TCPA. You may be able to collect between $500 and $1,500 per violation by filing a TCPA lawsuit or joining a TCPA class action lawsuit against the offending company.
