On September 4, 2024 James Barry joined the DOP as a partner in their Class Action Department. Mr. Barry has more than 15 years of experience representing individual and government entity plaintiffs in complex litigation in both federal and state court involving consumer fraud, wage theft, environmental contamination, data breaches and mass torts. Mr. Barry has served in leadership positions in multiple consolidated actions and mass torts includingย In re Experian Data Breach Litigation, 8:15-cv-01592-AG-DFM (C.D. CA.);ย In re Yapstone Data Breach Litigation, 4:15-cv-04429 (N.D. Cal);ย In re Physiomesh Litigation (Flexible Composite Mesh), MCL 627 (Atlantic County);ย In re Proceed Mesh Litigation (Proceed Surgical Mesh and Proceed Ventral Patch Hernia Mesh), MCL 630 (Atlantic County);ย In re Prolene Hernia System Mesh Litigation, MCL 633 (Atlantic County): andย Ogelsby v. Mr. Barry has argued multiple cases before the New Jersey Supreme Court and Appellate Division involving consumer rights, the enforceability of arbitration clauses, and the propriety of class certification including:ย Kernahan v. Home Warranty Admin. of Florida, 236 N.J. 301 (2019); Spade v. Select Comfort, 232 N.J. 504 (2018);ย Morgan v. Sanford Brown Institute, 225 N.J. 289 (2016);ย Moore v. Atlantic County, 2018 WL 4354304 (App. Div. 2018).
Mr. Barry has also tried cases to verdict in both New Jersey and Pennsylvania. In addition to his advocacy in the courtroom, Mr. Barry co-authored the chapter entitled NJ Class Actions in the 2020 New Jersey Mass Torts & Class Actions Treatise published by NJICLE. He has previously served as a co-chair of the New Jersey State Bar consumer law section and the New Jersey Association for Justiceโs consumer law section.
