AtlantiCare Health Services, Inc. Settles Class Action Over Alleged Undisclosed Illegal Fees
Plaintiff Adam DeMarco filed a proposed class action on behalf of all LifeCenter members, who between March 8, 2016 and March 31, 2023, became members of AtlantiCare Health Services, Inc. d/b/a AtlantiCare LifeCenter (the โClass Periodโ). Specifically, Plaintiff alleged that AtlantiCare charged LifeCenter members an extra month membership fee (โCancellation Feeโ) subsequent to members cancelling their membership and alleged such fee violated LifeCenterโs membership agreement as well as various New Jersey laws, i.e. the New Jersey Consumer Fraud Act, N.J.S.A. ยง 56:8-1, et seq.; the New Jersey Truth in Consumer Contract, Warranty and Notice Act, N.J.S.A. ยง 56:12-14, et seq.; and the Retail Installment Sales Act N.J.S.A. ยง 17:16C-24, et seq.. Defendant strongly denies the allegations.
Terms of the Proposed Settlement
The complete terms of the proposed settlement are set forth in the Settlement Agreement, which is available at www.AtlantiCareLifeCenterSettlement.com. The Settlement provides that Defendant will establish a Settlement Fund valued in the amount of $250,000 broken down into two separate funds: $100,000 to fund Class Member Claims and the cost of claims administration and notice; and $150,000 to pay for attorney fees and costs, subject to court approval, for time expended by Plaintiffโs counsel prosecuting the claim. In addition, as a result of the Settlement the Defendant has changed their businesses practices. If approved by the Court, the Settlement will result in dismissal of this case and final resolution of all claims raised against Defendant. Such dismissal will release Defendant from liability for all claims in this lawsuit.
