Court Approves $4.9M Class Action Settlement against Middlesex Water Company and 3M over PFO Contamination in tap water

Case: Vera et al. v. Middelsex Water Company and Lonsk v. Middlesex Water Company

Total Amount Recovered
$ 0

On October 3, 2025, New Jersey Superior Court Judge Ana C, Viscomi, J.S.C. of the Superior Court of New Jersey, Middlesex County granted final approval to a $4.9 million class action settlement against Middlesex Water Company and 3M to end two lawsuits involving water customers’ claims who received notices from Middlesex Water Company admitting that their tap water in 2021 violated New Jersey state water standards for Perfluorooctanoic acid (PFOA), a cancer causing chemical used in Teflon. The Middlesex Water Company notices recommended that certain water customers consult their doctors and use bottle water for drinking and/or install a water filter but did not offer to pay the costs of such measures. The settlement resolves two cases, Vera et al. v.

Middelsex Water Company pending in State Court and Lonsk v. Middlesex Water Company and 3M pending in New Jersey Federal Court. The settlement provided persons who submit claims to receive either $50 or up to $2,500, for reimbursement of monies they spent as a result of getting the Middlesex Wtaer Company notices. Attorneys representing the class are the firms: DeNittis Osefchen Prince, P.C., in Marlton and Javerbaum, Wurgaft, Hicks, Kahn, Wikstrom & Sininis of Voorhees, and Berger Montague, P.C. More information about the settlement and important documents about the case can be found at: http://www.middlesexwaterpfassettlement.com. Speaking as to the class action settlement, class co-counsel Stephen DeNittis stated:

This settlement represents a great recovery for Middlesex Water customers who otherwise would have been forced to bear the expense of paying for consultations with doctors, bottled water, water filters, or similar costs incurred as a result of the water quality violations described in the notices they received from Middlesex Water. We are very pleased with the result.
